Agreeing to these terms

Second Wind is a marketplace where members buy and sell pre-loved sports gear. By creating an account, listing an item or buying one, you agree to these terms. If you do not agree with them, please do not use the app.

You need to be 13 or older to use Second Wind. If you are under 18, use it with the permission of a parent or guardian, and remember that a purchase is a real commitment.

What Second Wind is, and what it is not

We run the marketplace: the listings, the messages, the checkout and the reviews. We are not the seller, and we never take possession of anything listed. Every sale is a contract between the buyer and the seller who posted the item, and it is their item, their description and their promise to post it.

Your account

Your account is yours, and you are responsible for what happens on it.

• Give us accurate details and keep them up to date, especially the email address and delivery address.
• Keep your password to yourself, and tell us if you think someone else has your account.
• One account per person. Do not impersonate anyone or post as someone else.
• We can suspend or close an account that breaks these terms, that we are required to close, or that puts other members at risk.

Listing and selling

If you list something, you are its seller. That comes with a few promises.

• The item is yours and you have the right to sell it.
• You describe its condition honestly, including wear and flaws. Use your own photos, and show the flaws you would want to know about.
• It is a real item that exists, is in your hands, and can legally be posted.
• No counterfeits, no stolen goods, and no worn-out or recalled safety equipment — helmets, harnesses, ropes and the like.
• Set one price that includes what it costs you to post the item, and post it promptly after it sells, to the address checkout gives you.

Buying

When you check out, you are asking the seller to send you that item. Read the listing and the photos, ask your questions through Messages before you buy, and pay through checkout only.

Keep payment inside Second Wind. A deal arranged off the platform is not covered by buyer protection, and we cannot help with money that never passed through the app.

Fees and payouts

Joining and listing are free. When an item sells, the buyer pays the seller's asking price plus a 6% marketplace fee and a service charge: $0.50 under $50, $1 from $50 up. The seller receives the price they set, less card processing of about 3%, paid out to the payout account they have connected.

Every fee is shown before a buyer pays, and nothing is taken out of the price a seller set except that card processing. Payouts follow the payment provider and the seller’s bank once payout setup is complete.

If an order goes wrong

Message the other member first, through the thread on the order: most problems are settled between the two of you. If that does not settle it, send us a message through the support form with the order number — as soon as you can, and within 30 days of the order at the latest.

Where an item never arrives, arrives damaged or is not as described, we can refund the buyer through the payment provider and ask for the item to be sent back to the seller. A refund for a problem the seller caused can also come out of their payout.

Reviews and how members behave

Rate only orders you actually took part in, and rate them honestly. Reviews are tied to the order they came from, so they cannot be written by anyone else.

Do not harass anyone, spam listings or messages, post content that is illegal or hateful, or try to move another member’s payment off the platform. We can remove a listing, a message or an account that does any of that.

Your content and our copyright

What you post stays yours. By posting a listing, a photo or a review, you give us permission to display it in the app and to include it in the messages and emails an order needs, so that selling works. Only post photos and text you have the right to use.

• If you believe something on Second Wind copies your work, send us a message through the support form with the listing and a description of the work. We review every notice and remove content that infringes.

Closing your account

You can delete your account at any time from your account menu. We will remove your profile, your listings and your personal details. Order and payment records are kept for as long as tax and accounting rules require, and a rating stays attached to the order it came from.

What we are responsible for

Second Wind is provided as it is. We cannot promise an item’s condition, that a member will do what they said, or that the app will never break. We are not liable for losses that follow from a deal between members, or for anything beyond what the law requires of us.

Nothing in these terms takes away rights you have under the law where you live.

Changes to these terms

If these terms change in a way that matters, we will post the update here and change the date at the top. Keep using Second Wind after a change and the new version applies. If you do not agree with it, you can delete your account.
